Terms of Service

These terms govern use of the software and services provided by Kache Register LLC (“Kache,” “we,” “us”), including our websites, applications, and the Kache platform. By creating an account or using the service you agree to these terms.

The service

Kache is a business-management platform: point of sale, scheduling, invoicing, inventory, customer records, payments, messaging, and related tools. Features vary by plan and by the modules a business enables.

Accounts

You are responsible for your account credentials and for activity under your account. Keep your information accurate, and tell us promptly about any unauthorized use. You must be authorized to act for the business you register.

Your data

The business records you store in Kache — products, customers, invoices, appointments — belong to you. You grant us the limited rights needed to host, process, back up, and display that data in order to provide the service. Our handling of personal information is described in our Privacy Policy.

Acceptable use

Don’t use Kache to break the law, send spam or unsolicited messages, infringe others’ rights, interfere with the service, or attempt to access another business’s data. You are responsible for obtaining any consents required to store and contact your customers, including consent to receive text messages.

Text messaging program (SMS)

Kache lets businesses send transactional text messages to customers who have opted in — appointment reminders, order and delivery updates, invoices and receipts, and replies to customer-initiated messages. Message frequency varies by business and activity. Message and data rates may apply.

Reply STOP to any message to opt out. You will receive a final confirmation message and no further texts will be sent. Reply HELP for help, contact the business that messaged you directly, or email hello@kacheregister.com. Consent to receive messages is not a condition of purchase. Carriers are not liable for delayed or undelivered messages.

Payments

Card processing is provided through our payment partners and may be subject to their additional terms. You are responsible for the accuracy of charges you submit and for handling refunds and disputes with your customers honestly.

Fees

Paid plans are billed on the schedule shown at purchase. Fees are non-refundable except where required by law. We may change pricing with reasonable advance notice; changes apply at your next billing cycle.

Availability and support

We work to keep Kache fast and available, but the service is provided “as is” without warranties of any kind. We may modify or discontinue features with notice where practical. Support is available at hello@kacheregister.com.

Limitation of liability

To the maximum extent permitted by law, Kache will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim is limited to the amounts you paid us for the service in the twelve months before the claim arose.

Termination

You may stop using the service at any time. We may suspend or terminate accounts that violate these terms. On termination you may export your data for a reasonable period before it is deleted.

Governing law

These terms are governed by the laws of the State of Missouri, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Jackson County, Missouri.

Changes

We may update these terms from time to time. Material changes will be posted here with an updated date; continued use of the service after changes take effect constitutes acceptance.
